Federal Judge Says California Can Regulate GHG Emissions from Autos

Today a federal judge rejected the auto industry's lawsuit challenging California's authority to regulate GHG emissions.

The controversial auto emissions law that California passed back in 2004 got its first day in court...and won!  Today, U.S. District Court Judge Anthony Ishii rejected the auto industry's lawsuit, saying that California IS able to enforce mandatory GHG emission reductions on cars, as long as the EPA approves.

That is an entirely separate hurdle that the state is currently battling.  The EPA has been considering California's request for a waiver of federal pollution standards since December 2005, and the state has filed suit over the delay. The agency has promised a decision by the end of the year.
